Gotchies Terms of Service

1. Acceptance of Terms By purchasing or using products from Gotchies ("we", "us", "our"), you ("customer", "you") agree to these Terms of Service. If you disagree, please refrain from using our website or products.

2. Products and Orders We offer high-quality organic cotton underpants available through our website. Product availability and descriptions are subject to change without notice.

2. Payments Gotchies accepts payments via credit cards, debit cards, PayPal, Venmo, and Apple Pay. Payments are securely processed, and customers agree to provide accurate billing information.

3. Shipping and Delivery We offer both standard and expedited shipping options. Shipping costs and delivery times vary based on the selected option and delivery location.

4. Return and Refund Policy Please refer to our detailed Return and Refund Policy:

Returns and refunds are eligible for orders made within the US. All international purchases are final sale.

Multi-Pack Return Guidelines (2, 3, 5 & 8-Packs)
If you ordered any multi-pack, you may open and try on only one pair to determine if the fit and feel meet your expectations. To ensure a smooth return process:
- The top pair in your box will be separated with tissue paper — this is your designated try-on pair.
- Please do not remove the tissue paper or handle the sealed pairs below unless you are certain you’re keeping them.
- If you choose to return the pack, the unopened pairs below the tissue paper must remain in their original condition.
- Kindly donate or repurpose the try-on pair, as we do not accept it back.
- We’ll cover the cost of return shipping (U.S. only).

Note for No-Fly Boxer Briefs:
- Each pair is individually packaged. The same return process applies — try on only one pair and keep the rest sealed if returning.

IMPORTANT:
For hygiene reasons, we cannot accept returns if any pair besides the designated try-on pair has been opened or handled. Refunds will not be issued in these cases. We appreciate your understanding and cooperation.

One-Pack Returns
If Opened:
If you've purchased a one-pack and are unsatisfied with the fit or size, we’re happy to offer a free size exchange (just cover the $5 handling fee).

Please note:
We cannot offer refunds on opened one-pack items, even if unworn or unwashed. We encourage you to gift the unwanted pair to a friend!

If Unopened:
If the packaging is still sealed, you’re eligible for a full refund. Just return it within 30 days of receiving your order.

Closet Cleanout 10-Pack (Final Sale)
The Closet Cleanout 10-Pack is heavily discounted and offered as a final sale item. It is not eligible for return or exchange.

However, if you receive the wrong size, a defective product, or experience any other issue with your order, please reach out to our customer support team (support@getgotchies.com) — we’re happy to make it right on a case-by-case basis.

Note: International purchases are final sale and not eligible for returns or refunds.

4. Privacy We collect contact information, payment details, purchase history, and customer service communications. We do not share your information except as required for payment processing, shipping, compliance with laws, or to protect our rights. For full details, please see our Privacy Policy.

5. Intellectual Property Gotchies retains ownership of all trademarks, logos, designs, content, and intellectual property on our website. Unauthorized use of our intellectual property is prohibited.

6. User Conduct Users agree not to misuse our website, engage in fraudulent activities, or infringe upon intellectual property rights.

7. Accounts Customers may create accounts to manage their orders and information. Users are responsible for maintaining confidentiality and security of their account information.

8. Limitation of Liability Gotchies is not liable for any indirect, incidental, consequential, or punitive damages arising from products sold, beyond the refund or replacement of purchased items.

8. Product Warranty and Liability Products are sold "as is" without additional warranties. Gotchies is not responsible for normal wear and tear or misuse of products.

9. Intellectual Property Gotchies' trademarks, logos, designs, and website content are protected intellectual property and cannot be used without our express written consent.

10. Governing Law These Terms are governed by the laws of the jurisdiction applicable to your location within the United States.

11. Changes to Terms We may periodically update these Terms. Changes become effective immediately upon posting on our website.

Mobile Terms of Service

The Gotchies mobile message service (the "Service") is operated by Gotchies (“Gotchies”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Gotchies’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Gotchies through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Gotchies. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18776844348 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Gotchies mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
